Statement of the Ministry of Education and Science of the Kyrgyz Republic
"The draft Law of the Kyrgyz Republic ‘On Education’ contains conceptually revised provisions of the current legislation in the field of education and science, taking into account advanced international practice.
The draft Law of the Kyrgyz Republic ‘On Education’, as the flagship of the country’s legislation in the field of education, should systematically define the foundations of the legislation of the Kyrgyz Republic on educational and scientific activities, establish a clear hierarchy of regulatory legal acts within the country’s education legislation, and their correlation with the civil legislation of the Kyrgyz Republic as a whole.
The draft Law of the Kyrgyz Republic ‘On Education’ is intended to determine the fundamental principles for carrying out educational and scientific activities, to establish clear legal regulation of relations arising in the course of organising and regulating educational and scientific activity, to streamline the procedures for the creation and licensing of educational organisations and other persons providing educational services in the prescribed manner. The draft Law aims to set out clear rights, duties and responsibilities of all participants in education and science in their interaction with one another and with external entities, and to ensure timely supervision and increase its effectiveness, including on a consolidated basis.
The draft Law of the Kyrgyz Republic ‘On Education’ is primarily aimed at orienting the education system towards achieving sustainable economic growth. It is aimed at harmonising laws and other regulatory legal acts in the field of educational and scientific activity, systematising their provisions, eliminating existing internal contradictions and conflicts, and filling gaps in legal regulation in education and science. As a result of adoption of the draft law, it is expected that public trust and the confidence of domestic and foreign investors in the education and science system will increase, as will the country’s investment attractiveness.
The provisions of the draft Law of the Kyrgyz Republic ‘On Education’ are given the character of direct effect to the maximum extent possible, ensuring the necessary balance between state and public interests in securing the stable functioning of the educational and scientific system, the interests of citizens, as well as those of educational, scientific and scientific-technical organisations, their participants and founders.
The provisions of the draft Law of the Kyrgyz Republic ‘On Education’ are also aimed at protecting the rights of consumers of educational services, and ensuring their rights and legitimate interests."
